OIC Ltd. vs. Rekha Devi & others FAO No.343 of 2019 01.12.2025 Present: Mr.Sambhav Bhasin, Advocate, for the appellant. Ms. Anjali Soni Verma, Advocate, for the respondents. On 11.11.2025, this Court had allowed the application CMP No.26214 of 2025 directing the release of award amount in favour of respondents No.1, 3 and 4. The Registry, however, raised an objection/query that as per the award passed by learned Motor Accident Claims Tribunal no compensation had been awarded to applicant No.3, but he has now become entitled to part of compensation after inheriting it from petitioner No.2 who is stated to have died after passing of the award. In this manner, compensation awarded to petitioner would be divided between applicants No.1, 3 and 4, but there is nothing on record that in what proportion it is to be distributed. It is also not known whether petitioner No.2 had died intestate or not. Confronted with this, learned counsel seeks a week’s time to file supplementary affidavit to clarify the factual aspect.
