1. Heard the parties. 2. This anticipatory bail application under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Sections 406/420/34 of the Indian Penal Code. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The allegation against the petitioner is that on the pretext of providing job, the petitioner has taken money from the informant, but neither provided him the job, nor refunded him the money. In the FIR it is also mentioned that other accused persons have also taken money from the informant. 5. So far as this petitioner is concerned, it has been argued by learned counsel for the petitioner that the entire allegation is false. He submits that no assurance was given that the informant will be provided with Govt. job. Rather the documents annexed with the FIR which are agreement and legal notice, suggests that the

petitioner had taken friendly loan which he could not repay, as a result of which, this case has been lodged. 6. After hearing the parties, I have gone through the agreement which forms part of the FIR wherein the petitioner has given an undertaking that since he has taken the friendly loan of Rs. 75,000/-, he will refund the same and on failure to refund the same within specified period, he will pay interest also. A legal notice is also annexed where there is a reference of the earlier agreement, which suggests that the petitioner has taken money by way of friendly loan, but has not refunded the same. 7. Considering the fact that the issues relates to friendly loan only and has been given a color of cheating in providing job, this Anticipatory Bail Application stands allowed.
The petitioner above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dumka, in connection with Dumka (Town) P.S. Case No. 69 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
