Heard Sri Pramod Kumar Srivastava, learned counsel for the opposite party no.2 and learned AGA for State. The present criminal revision has been filed against the judgment and order dated 24.02.2023 passed by Juvenile Court/Special Judge (POCSO Act), Kaushambi, in Criminal Appeal No. 08/2023 (Gya ABCT Vs. State of U.P. and others) arising out of case crime no. 207 of 2022, under sections 376 IPC and 3/4 of POCSO Act, Police Station- Karari, District- Kaushambi. The prayer has been made in this revision for cancelling the bail granted to the opposite party no.2 vide order dated 24.02.2023. Learned AGA and learned counsel for opposite party no.2 are present. From the perusal of the order passed by this Court shows that the order has been passed on the basis of favourable report of District Probation Officer is favour of opposite party no.2. He was not found to be having any criminal history and at the time of incident he was aged about only 14 years, 2 months and 3 days. The court has also found that there court has recorded finding that there is no possibility of the opposite party no.2 coming in contact with known criminals.
