GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 5th respondent in issuing an undated Survey Notice at the behest of the 4th respondent to the petitioner (served through WhatsApp on 13.08.2025) and trying to conduct a survey in petitioners land admeasuring 1098 Sq.Yards located in Sy.No.356, Avilala Gram Panchayat, Oteru Village, Tirupati Rural Mandal, Tirupati District as illegal, arbitrary, without jurisdiction and also violative of Article 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere with the possession and enjoyment of the petitioners land admeasuring 1098 Sq. Yards located in Sy.No.356, Avilala Gram Panchayat, Oteru Village, Tirupati Rural Mandal, Tirupati District without following the due process of law.” 2 2. Sri N.V.Sumanth, learned counsel for the Petitioner would submit that the Police are interfering with the possession and enjoyment of the Petitioner over the subject property and Respondent No.5 issued an undated service notice to the Petitioner through Whatsapp at the behest of Respondent No.4 and trying to conduct the Petitioner’s land measured. 3. Ms.A.Jayanthi, learned Government Pleader for Home, would submit that, the Police have nothing to do with the issuance of the alleged notice by the Surveyor. It is further submitted that the Police have simply registered the crime and are doing investigation in the said crime. 4. Sri Bhagath Singh, learned Assistant Government Pleader for Revenue would submit that the surveyor received an application from one G.Srinivasa Rao through Mee-Seva and on the said application the Surveyor issued notice to the Petitioner for conducting survey. . 5. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out his remedies before appropriate forum on receipt of notice from the Surveyor for conducting survey, since Police are not interfering in the matter. There shall be no order as to costs.
