Order 22/01/2025
1. Apprehending their arrest in connection with FIR No.807/2024, registered at Police Station Muhana, District Jaipur, for the offence(s) under Section 303(2) of B.N.S., the accused- petitioners have preferred this criminal misc. bail application under Section 482 of B.N.S.S.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is contended that the recovery of tractor has already been made and the present accused-petitioners are implicated solely on the disclosure statement of the other co-accused, custodial interrogation of the accused-petitioners are not required, the accused-petitioners are ready and willing to co-operate with the
[2025:RJ-JP:3271] (2 of 3) [CRLMB-11676/2024] investigation, therefore, the anticipatory bail application of the accused-petitioners may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application of the accused-petitioners and submitted the factual report alongwith the case diary.
4. Heard and perused the material available on the record.
5. The case diary shows that apart from the disclosure statement of the other co-accused, there is no substantive evidence available on the record regarding involvement of the present accused-petitioners in the alleged crime and no CCTV footage is placed on record or in the case diary regarding the same. The recovery of the stolen tractor has already been made from the other co-accused, therefore, considering the above facts, I deem it just and proper to allow the anticipatory bail application of the accused-petitioners.
6. Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the petitioners- 1. Ashok Meena S/o Ganga Vishan Meena and 2. Naresh Meena S/o Gyanchand Meena, in connection with FIR No.807/2024, registered at Police Station Muhana, District Jaipur, they shall be released on bail, provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or
