IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 12 of 2025 Ashok Bharti, aged about 23 years, son of Budhan Bharti, resident of village- Karailibar, P.O.- Bashishth Nagar, P.S.- Bashishth Nagar, District- Chatra. … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Akhouri Awinash Kumar, Advocate For the State : Mr. Vishwanath Roy, Spl.P.P. --- 02/10.01.2025 Heard the parties. The petitioner has been made accused in connection with POCSO Case No.78 of 2023, arising out of Bashishth Nagar P.S. Case No.55 of 2023, for the offences registered under Sections 341, 323, 324, 307, 354, 452 of the Indian Penal Code and Section 8 of the POCSO Act, pending in the court of learned Special Judge, (POCSO), Chatra. On 06.08.2023 at about 10:15 P.M., the petitioner entered into the house of the informant and started molesting her minor daughter. When the informant opposed his nefarious activities, the petitioner inflicted knife blow on her person causing injuries. It appears that the statement of the informant and the victim have been recorded during trial and they had supported the prosecution case. Considering the nature of allegation and the fact that trial is under progress, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall expedite the trial. (Ambuj Nath, J.) Jay/-
