Neutral Citation No. - 2025:AHC:40660-DB Court No. - 40 Case :- WRIT - C No. - 7863 of 2025 Petitioner :- Ram Chandra Ram Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ashish Jaiswal,Siddarth Jaiswal Counsel for Respondent :- C.S.C.,Udit Chandra Hon'ble Shekhar B. Saraf,J. Hon'ble Kshitij Shailendra,J. 1. Heard learned counsel appearing on behalf of the petitioner, learned Standing Counsel appearing on behalf of the State respondent and Sri Udit Chandra, learned counsel appearing on behalf of the respondent Nos. 2 and 3. 2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the illegal action of the respondent authorities in carrying the permanent disconnection of electricity line of the petitioner on a complaint made by his brother. 3. It is to be noted that a notice was issued on November 20, 2024 with a direction upon the petitioner to give a reply within three days. However, the Electricity Department even did not wait and on the same day, that is, November 20, 2024, disconnected the electricity line of the petitioner. The entire action taken by the respondent authorities, in our view, is arbitrary, mala fide and without any principles established in law. 4. In light of the same, the authority concerned is directed to re-connect the electricity line of the petitioner within three days from date. Subsequent to re- connection taking place, the petitioner is directed to file reply to the notice dated November 20, 2024 within seven days. Once the reply is filed, opportunity of hearing should be granted to the petitioner, and thereafter, the respondent authorities shall pass a reasoned order in accordance with law. 5. With the above directions, the writ petition is disposed of. Order Date :- 19.3.2025 Kuldeep (Kshitij Shailendra, J.) (Shekhar B. Saraf, J.)
