The Writ Petition is filed questioning the inaction of the respondents in withholding the payments of total amount of Rs.64,84,831/- [(1) Rs.35,54,639/- for the work done pertaining to Kanigiri Municipality – General Funds 2022-23/ASC Grant/Other Government Grant – Providing Transportation of Drinking water through tankers in 1 to 10 Wards of Kanigiri Municipality (For the month of February 2023 & March 2023) (3rd Call) of Estimate Cost of Rs.40.0 Lakhs and (2) Rs.29,30,192/- for the work done pertaining to Kanigiri Municipality – General Funds 2022-23/ASC Grant/Other Government Grant – Providing Transportation of Drinking water through tankers in 11 to 20 Wards of Kanigiri Municipality (For the month of February 2023 & March 2023) (3rd Call) of Estimate Cost of Rs.40.0 Lakhs, is illegal and arbitrary. 2. Heard Sri G.Arun Showri, learned counsel for the Petitioner and Sri Gudapati Lakshmi Narayana, learned Standing Counsel for the Respondent No.8-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.8 - Municipality passed on the written instructions 3 signed by the Commissioner, Kanigiri Municipality, wherein it was stated that the bills have been uploaded in the CFMS portal for a total amount of Rs.64,84,831/- on behalf of the petitioner. The said amount includes Rs.35,44,134/- uploaded in CFMS vide token No.2024-817349 and Rs.28,75,144/- uploaded in CFMS vide token No.2024-817359 for the above two works respectively. It was also stated that in CFMS portal, the bills were uploaded and the status of the bills is waiting for fund clearance. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order. There shall be no order as to costs.
