The case of the petitioners is briefly as follows: The respondent No.2, U.Ramesh Babu, lodged a complaint on 09.08.2025 to the effect that on 12.11.2020, K.Siva Prakash had gifted his land measuring of Ac.1.41 ½ cents to Sri Srinivasa Charitable Trust, Vayalpad, through a registered gift deed and on 27.11.2020; that K.Siva Prakash had bequeathed his house vide D.No.5-5 to Sri Srinivasa Charitable Trust through a will (veelunama); that on 15.12.2020, A-1 Nakkala Thulasamma, A-2 Nakkala Venkataswamy and A-3 P.Pawan Kumar had created a forged partition deed at Sub-Registar’s office in Madanapalli with the help of A-4 Rajendra (document writer) and got registered the land and house in the name of A-1 Nakkala Thulasamma by using forged thumb impressions of K.Siva Prakash; and that in the month of July, 2025, when the trust members visited the land and house, A-1 to A-3, stating that the land belonged to them and had threatened that if anyone enters into the land, they will kill them. 3. Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor, representing the respondent No.1, submitted that Section 35(3) of B.N.S.S. would be followed as the offences covered by the F.I.R. are within the scope of it. 4. As such, the learned counsel for the petitioners requested to dispose of the criminal petition recording the same. 5. In the result, the petition is disposed of directing the Station House Officer concerned to follow Section 35(3) of the B.N.S.S. 3 Crl.P.No.8837 of 2025 There shall be no order as to costs.
