VIVEKANANDA VIRUPAKSHA 4.VENNA HEMANTH KUMAR(CENTRAL GOVERNMENT COUNSEL) CORAM: THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI 22.08.2025 DATE JUDGMENT (Per Sri Justice Ravi Cheemalapati) Challenging the order dated 29.07.2025 passed by a learned single Judge in Writ Petition vide W.P.No.5354 of 2025, the petitioner therein preferred this intra court appeal under clause 15 of Letters Patent. 2. Heard Sr/ Gunda/a Sivaprasad Reddy, learned counsel for appellant, and Venna /-/emanth Kumar, /earned Centra/ Government Counse/. 3. For convenience, the parties hereinafter will be referred to with their status in the writ petition. 4. The writ petition was filed challenging the action of respondent no.4 in withdrawing recognition of petitioner's institution, which was confirmed by respondent no.5 in appeal, as illegal and arbitrary. 5. The material on record would indicate that having found deficiencies. the respondent no.4, after issuing preliminary as well as final show cause .WJl.[N'o.923 of2025 4 notices and after considering the reply submitted by the petitioner, withdrew the recognition earlier accorded to the petitioner institution to conduct B.Ed., two years course with annual intake of 150 students, from the next Academic year. The appeal preferred by the petitioner under Section 18 of the National Council for Teacher Education Act, 1993 was dismissed by respondent no.5. Challenging the same, this writ petition is filed. 6. The learned single Judge, upon considering the pleadings as well as the submissions made by learned counsel for the parties, having found that in view of deficiency in compliance of the conditions of the revised recognition order, the authorities rightly withdrew the recognition granted to the petitioner institution, disposed of the writ petition, giving liberty to the petitioner to make application afresh for according recognition and the respondents shall consider the same in accordance with law for the next academic year. 7. Sri Gundala Siva Prasad Reddy, learned counsel for the appellant. while reiterating the contents of the writ affidavit and grounds of appeal. would contend that there is no dispute regarding rectification of the deficiencies by the petitioner institution pointed out in withdrawal order and since the admission process would continue for another three (03) months. .^AMo.923 of2025 5 the learned single Judge ought to have directed the authorities to restore the recognition of the petitioner institution for the academic year 2025-26. Accordingly, prayed to allow the writ petition. 8. The order impugned in this writ appeal shows that in response to the submission made by the learned counsel for the petitioner for restoration of recognition of the petitioner institution from the Academic year 2025-26, the learned counsel for respondent nos. 4 and 5 submitted that admission process for the academic year 2025-26 had already commenced and hence it is not feasible to consider the case of the petitioner for the Academic year 2025-26. In view of the submission made by the learned counsel for respondent nos. 4 and 5, the learned single Judge thought it fit to grant liberty to the petitioner institution to make application afresh for next academic year. 9. As could be seen from grounds of appeal, commencement of admission process for academic year 2025-26 even by the date of disposal of the writ petition is not denied. As already stated the only ground urged is that since the admission process may go on for another three (03) months, the recognition of the petitioner institution be restored from the academic year 2025-26. ■ .WA-^0.923 of2025 6 10. Since the admission process had commenced even by the date of disposal of the writ petition, restoring the recognition of the petitioner's institution would disrupt the admission process. Therefore, the learned single Judge had rightly granted liberty to the petitioner institution to submit application afresh for according recognition for the next academic year. The order so passed by the learned single Judge, in our view, does not require any interference. The writ appeal being meritless deserves dismissal. 11. Accordingly, the writ appeal is dismissed.
