THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE HEMANT CHANDANGOUDAR ORAL ORDER The petitioners, who are facing investigation for offences punishable under Section 498-A of the IPC and Sections 3 and 4 of the Domestic Violence Act, 2005, have approached this Court seeking relief. - 3 - NC: 2025:KHC:10353 CRL.P No. 7753 of 2024 2. The prosecution alleges that accused No.1 (the husband), accused Nos.2 and 3 (the parents-in-law), and accused No.4 (the sister-in-law) subjected the de facto complainant to mental and physical cruelty and demanded that she bring money from her parental home. 3. The parties are present before this Court and have filed an application under Section 320 of the Cr.P.C., stating that they have amicably resolved their dispute in the petition filed by the de facto complainant for the dissolution of her marriage with accused No.1. As per the settlement, the de facto complainant has agreed to withdraw all allegations and has no objection to quashing the impugned proceedings. The said application is placed on record. 4. Although the offences alleged against the petitioners are cognizable and non-compoundable, considering that the parties have amicably resolved the dispute, subjecting the petitioners to investigation would serve no purpose. In light of the settlement, the likelihood of the police filing charge sheet is remote and bleak. 5. In view of the above, continuing the criminal investigation against the petitioners would amount to an abuse of the process of law. - 4 - NC: 2025:KHC:10353 CRL.P No. 7753 of 2024 6. Accordingly, the petition is allowed. The impugned FIR in Crime No.32/2024 registered by the Women Police Station North East Division is hereby quashed.
