PUBLIC PROSECUTOR The Court made the following Order: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘BNSS’) (for brevity ‘BNSS’) seeking to enlarge the Petitioner/Accused No. 10 No.68 of 2025 of Varadaiahpalem Police Station, Tirupati District for on bail in Crime the
5. Heard leaned counsel for the Petitioner and learned Assistant Public Prosecutor. Perused the record. 6. The allegation against the Petitioner/Accused No. 10 is that he acted a pilot for transportation of certain red sandar logs to the desired destination. Although, it is reported that there is one adverse antecedent against the Petitioner, that itself is not a ground to denying the request of the Petitioner for releasing him on regular bail.
The Petitioner was arrested on 23.07.2025 and he has been in judicial custody for 37 days. There altogether 11 Accused in this case. The main Accused is Accused No.5, who purchased red sander logs. So far, 7 witnesses have been examined. Majority of them are official witnesses. Material witnesses are examined. Major portion of the investigation is completed. The Petitioner is permanent resident of Venkata Reddy Palem Village, Ozili Mandal, Tirupati District. Therefore, Petitioner may not be in a position to threaten them or hampered the investigation or tampering the evidence may not arise. as are

Considering the nature and gravity of allegation levelled against the petitioners, his alleged role played in this case, and the period of detention f undergone by the Petitioner, this Court is inclined to enlarge the Petitioner bail with the following stringent conditions: on i. The Petitioner/ Accused No. 10 shall be enlarged on bail subject to his executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties each fc^r the like sum
each to the satisfaction of the learned Judicial Magistrate of First Class for Trial of Cases relating to Red Sanders Smuggling, Tirupati. ii. The Petitioners/Accused No. 10 shall appear before the Station House Officer, Varadaiahpalem Police Station, Tirupathi District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The Petitioners/Accused No. 10 shall not leave the limits of the District without prior permission from the Station House Officer concerned. The Petitioners/Accused No. 10 shall not commit or indulge in commission of any offence in future. The Petitioners/Accused No. 10 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required, vi.
The Petitioners/Accused No. 10 shall not, directly indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer, vii.
