Raipur (CG), to prevent the miscarriage of justice. 3. Direct the learned trial court to record the accused statement under section 313 of the code of criminal procedure, 1973, afresh, enabling the accused/applicant herein a proper opportunity to offer a plausible explanation of the matter.” 2. From the CIS report of the learned trial Court concerned which has been brought on record by the Registry of this Court regarding the disposal of Sessions Case No.35/2018, it appears that the said case has already been disposed of by the concerned trial Court vide order dated 06.01.2022. 3.
