JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 23-04-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Madhuban P.S. Case No. 315 of 2024 dated 29.07.2024 registered for the offences punishable u/ss 126(2), 115 (2), 118 (1), 109, 76, 303(2), 329(4), 89 and 352 of the BNS. 3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have attacked the informant’s house and started damaging the property situated behind her house. When the informant protested, all the accused persons entered her house and started committing loot, in the meantime, Jitendra Ram Vicky, Ram Ekbal Ram and Prince Kumar started Patna High Court CR. MISC. No.19534 of 2025(2) dt.23-04-2025 2/3 disrobing and molesting the informant. When the informant and her family members were about to go the police station, in the meantime, all the accused persons again entered the house of the informant and started assaulting her husband with knife with the intention to kill, causing injury to him and Prince Kumar started pressing the neck of the informant’s father-in-law due to that he became unconscious. It is further alleged that the accused persons again assaulted the informant resulting the miscarriage of two months’ old fetus and the accused persons also snatched golden Dholna, Mangal Sutra and Rs. 40000/- and a mobile phone. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 16.11.2024. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- Patna High Court CR. MISC. No.19534 of 2025(2) dt.23-04-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Madhuban P.S.
