The petitioner has been made accused in connection with Barhi P.S. Case No. 242 of 2024, for the offence registered under Section 376(2)(n) of the Indian Penal Code and Section 6 of POCSO Act, pending in the court of learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag. Bail application of the petitioner was earlier rejected by this Court in B.A. No. 7291/2024 vide order dated 29.10.2024. Petitioner is said to have entered into physical relationship with the victim who is aged about 18 years. Petitioner promised to marry her. Later on, he refused to do so. While rejecting the bail application of the petitioner, the statement of the victim recorded under Section 164 Cr.P.C. was perused, in which, she has stated that the petitioner was also having illicit relationship with one Suhani Kumari and when he refused to marry her, she committed suicide. Mr. A. K. Kashyap, learned senior counsel appearing for the petitioner has drawn attention of this Court towards the F.I.R. of Barhi P.S. Case No. 76/2023, which relates to suicide of Suhani Kumari and from perusal of which, it appears that another person namely Sudhansu Kumar is -2- an accused in that case and the petitioner is not an accused. In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag, in connection with Barhi P.S.
