IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.9865 of 2023 Date of Decision: 25.11.2025 _____________________________________________________________________ Ranjan Kamath ……...Petitioner Versus State of Himachal Pradesh & Ors. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Suresh Singh Saini, Advocate. For the respondents: Mr. Rajan Kahol, Mr. Vishal Panwar, Additional Advocates General with Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for respondent No.1- State. Ms. Kanta Thakur, Advocate, for respondents No.2 & 3. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) By way of instant petition, petitioner has prayed for the following main relief:-
“a. Issue a writ of mandamus directing the Respondent authorities to declare the pending result of the petitioner and supply the pending DMC’s in time bound manner in the interest of justice and fair play.”
2. Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by Mr. Suresh Singh Saini, learned counsel representing the petitioner, is that though petitioner has already completed his B.Pharma from the respondent/University in the year 2020, but his mark sheet (DMC) has not yet been issued on the ground of non-availability
of the original record, which is stated to be lying deposited with the learned trial Court. 3. Pursuant to notices issued in the instant proceedings, respondents No.2 & 3 have filed reply, wherein factum with regard to petitioner’s having done B.Pharma from the College concerned has not been denied, but it has been stated that detail mark sheet (DMC) could not be released on account of clerical errors. 4. Ms. Kanta Thakur, learned counsel for the respondent/University, states that since there is a variation of marks in 3rd and 4th semesters, detailed marks sheet for the entire course could not be issued to the petitioner. She further submitted that in similar facts and circumstances, detailed mark sheets (DMC) of other candidates are being released/issued after making necessary corrections in the original record, which is lying to be deposited with the learned trial Court. She submitted that in case appropriate application is made by the petitioner to the court concerned for correction and thereafter, respondent No.2 is permitted to carry out correction in the detailed mark sheet, as prayed for, in the instant petition, the same can be ordered to be released. 2
5.
Admittedly, in the case at hand, petitioner is not at fault, rather he has passed the examination, but on account of pendency of litigation, his mark sheet (DMC) has not been released, as a result thereof, he is unable to seek employment or pursue further studies. Since it stands established that the record, from where verification and correction can be made, is lying deposited with the learned trial Court, Solan, this Court deems it fit to dispose of the present petition reserving liberty to the petitioner to file appropriate application before learned trial Court/Special Judge, Solan, where original mark sheet (DMC) register already stands deposited and thereafter, learned trial Court may pass appropriate orders thereupon. Since petitioner is running from pillar to post for getting his mark sheet (DMC) for quite long, this Court hopes and trusts that needful shall be done by the learned trial Court/Special Judge expeditiously, preferably within ten days after the receipt of application, if any, made, pursuant to direction contained in the instant order/judgment. Pending application(s), if any, stand disposed of. November 25, 2025 (Sandeep Sharma), (sunil)
