THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 22840 of 2025 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ, order, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Nos. 4 and 5 failing to act on the petitioner's reports dated 25.07.2025, despite of injuries, as illegal, arbitrary, unconstitutional, and in violation of Articles 14 and 21 of the Constitution of India, and consequently direct the respondents to take appropriate action against the erring police officials for failure of duty and further direct registration of a proper FIR based on the petitioner’s complaint dated 25.07.2025 and Direct the respondents to provide police protection to the petitioner and his property and pass such.…”
2. Heard Sri Bilaal Ahmed Syed, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. The Learned Assistant Government Pleader for Home, on written instructions, respectfully submits that, initially, based on a complaint lodged by one Rayudu Padma, a case was registered against the petitioner's father and two others in Crime No.305 of 2024 of Mogaltur Police Station. Upon completion of investigation, a charge sheet was filed, which has been taken cognizance of and is now pending as C.C No.88 of 2025 on the file of the Additional Junior First Class Magistrate, Narsapuram.
Subsequently, two counter-cases were registered on the basis of complaints lodged by the petitioner's mother and sister. Upon investigation, both these cases were

found to be false and were accordingly closed. Thereafter, based on another complaint filed by the said Rayudu Padma, a further case was registered against the petitioner and three others in Crime No.44 of 2025 for offences punishable under Sections 126(2), 324(4), and 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. After due investigation, a charge sheet was filed, which is now numbered as C.C. No.159 of 2025, and the matter is presently at the P.T stage. 4. Recording the above said submissions, the Writ Petition is disposed of. No costs. However, the petitioner is directed to approach the police and pursue his complaint which is pending for consideration before the police.
