Sy.No. 1772 to an extent of Ac 0.003 Cents, Plot No. 238 and Sy.No. 1772, extent of Ac 0.03 Cents, in plot No. 239, in spite of their being an order in O.S. No.455 of 2023 in I.A. No. 1575 of 2023, on the file of the Hon'ble Court of Principal Junior Civil Judge, Badvel, as illegal, arbitrary and violation of Articles 14, 19 21 and 300-A of the Constitution of India and consequently direct the respondent No. 5 to provide police aid to the petitioner's subject property and pass such other order or orders as this Hon'ble Court deems fit and proper in the facts and circumstances of the case and in the interest of justice, and to pass.…” 2. Heard Sri S. Rama Lakshmana Reddy, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioners would submit that the grievance of the petitioners is that respondent No.5 is not providing police aid to their property. 4. Learned Assistant Government Pleader for Home would submit that there are civil disputes regarding the subject property. Unless and until a direction is issued by the competent Civil Court, the police are not empowered to redress the grievance of the petitioners by providing police aid. He further would submit that a criminal case in Cr.No.283 of 2024 was registered with regard to the subject property and the investigation is still pending for want of certain documentary evidence from the Revenue Department. 5. Recording the above said submissions, the Writ Petition is disposed of. However, the petitioner is at liberty to workout their remedy before the competent Civil Court where a civil suit is pending. There shall be no order as to costs.
