Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 02.05.2025 1. The petitioner has filed these petitions seeking the following reliefs: “1-That the Hon'ble court may be kind enough to call the record of the petitioner as well as other respondent no.1 & 2. 2-That the Hon'ble Court may be kind enough to issue a 3 writ/ writs, order/orders, direction/ directions in the nature of mandamus and to command the respondent no.1 & 2 to take appropriate action on the application of the petitioner. 3-That the Hon'ble Court may be kind enough to pass any appropriate writ, order or direction as deem fit in the circumstances of the case.” 2. Learned counsel for the petitioner would submit that the petitioner moved an application before respondents No.1 & 2 for cancellation of counter signature according to the provisions of Section 86 of the Motor Vehicles Act. He would contend that till filing of these petitions, no appropriate action was taken by respondents No.1 & 2, in this regard. He would contend that a direction may be issued to respondents No.1 & 2 to take appropriate action on the pending representations of the petitioner. 3. On the other hand, learned counsel appearing for the respondents would oppose the submissions made by counsel for the petitioner. 4. Heard. 5. Taking into consideration the submission made by counsel for the petitioner, these petitions are disposed of with a direction to respondents No.1 & 2 to take an appropriate decision on the pending representations of the petitioner. However, the petitioner would be at liberty to make a fresh representation before the Competent Authority and in turn, the respondent authorities are -4- directed to pass appropriate orders, strictly in accordance with law, if such orders have not already been passed. 6.
