This petitioner has been filed by the petitioner seeking modification in the order dated 05.09.2022 passed in MCRC No.5839/2022. 2. Learned counsel for the petitioner submits that vide order dated 05.09.2022 passed in MCRC No.5839/2022, the petitioner was granted bail by this Court on the conditions that he shall furnish Digitally signed by RAMAKANT NIRALA 2 his original Aadhar card, driving licence, votor ID. Apart from it, he shall also surrender his passport before the Trial Court and shall not leave the country without permission of the Trial Court. He further submits that when the petitioner filed application for supurdnama before the Trial Court, but the same has been rejected. He next submits that the wife of the petitioner is foreigner (russian) and they are also having one daughter, as such they need to go to foreign, but due to seizure of the original documents such passport, ID Card etc., the petitioner is unable to go. Therefore, the order dated 05.09.2022 may kindly be modified. 3. Learned State counsel formally opposes the prayer of the petitioner. 4. Heard learned counsel for the parties and perused the material available on record. 5. This Court vide order dated 05.09.2022 passed in MCRC No.5839/2022 granted bail to the petitioner on the following conditions:- “(i) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (ii) He shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (iv) He shall furnish his original Aadhar Card, Driving License, Voter ID Card and current mobile number. (v) He shall surrender his passport before the Court below and shall not leave the Country without the 3 permission of Court below. (vi) The learned trial Court is at liberty to impose any other condition, as it deem ft.” 6. On perusal of the aforesaid order, the prayer of the petitioner appears to be reasonable, therefore, the order dated 05.09.2022 is modified to the extent that in para 9, conditions No.(iv) & (v) be read as under:- “(iv) He shall furnish photocopies of his Aadhar Card, Driving licence, voter ID Card and current mobile number. (v) He shall not leave the country without permission of the Trial Court.” However, the other conditions shall remain intact. 7. The CRMP stands disposed of. Sd/- Rajani Dubey Judge Nirala
