This writ petition is filed declaring the action of Respondent Nos.4 to 7 in interfering with the Petitioner’s functioning as
“Village Organization Assistant (VOA) of Respondent No.8- Society in contravention of Circular No.64-7/SERP/IB/2019 dated 29.08.2019 as illegal and arbitrary. 2. The Petitioner was appointed as Village Organization Assistant in Respondent No.8-Society which is a registered society and functioning under the provisions of the Andhra Pradesh Mutually Aided Cooperative Societies Act, 1995 and its own bye-laws.
As the Official Respondents are restraining the Petitioner from discharging his duties as Village Organization Assistant of Respondent No.8-Soceity, the present writ petition is filed. 3. Respondent No.8 –Society is said to be a Mutually Aided Cooperative Society and the private employment of the Petitioner in Respondent No.8-Society cannot be the subject matter of the present writ petition, as Respondent No.8 is not a ‘State’ under Article 12 of the Constitution of India. 5
4. Accordingly, the writ petition is dismissed. However, liberty is given to the Petitioner to avail alternative remedies under law in an appropriate forum. There shall be no order as to costs.
