Petitioner has been made an accused in connection with S.T case no. 80 of 2023, arising out of Mihijam P.S Case no. 54 of 2022, registered under Sections 395 of the Indian Penal Code and section 27 of Arms Act, pending in the Court of learned Additional Sessions Judge 1st, Jamtara. Bail application of the petitioner has been earlier rejected twice by coordinate bench of this Court. On 12.05.2022, the informant was waylaid by unknown dacoits near Bodma Pole factory. The miscreants looted cash, mobile phone and other articles from him. It appears that the petitioner was identified in the T.I. Parade. Learned lawyer for the petitioner submitted that the informant has been examined during the trial and he has not identified the petitioner in the dock. Regard being had to the facts and circumstance of the case and considering the nature of allegation and the fact that the trial of this case is under progress; I am not inclined to enlarge the petitioner on bail.
