1. Mr. Shobit Saharia,
learned counsel for the petitioner.
2. Petitioner has alleged disobedience of interim order dated 21.02.2025 passed by learned Single Judge in WPMS No. 3273 of 2024. By the said
order, Authorities were restrained from giving effect to the amendment made in Rule 12(b) of 2018 Rules.
3. It is alleged that despite the said
order, elections were held as per the amended Rules.
4. Learned State Counsel, however, points out that the interim order, sought to be enforced by the petitioner, was challenged in SPA No. 16 of 2025, which was dismissed by Division Bench on 27.02.2025. In terms of the judgment rendered by Division Bench in the said special appeal, the election process has been re-notified. Thus, he submits that the grievance raised by the petitioner in this contempt petition is without any substance.
5. This Court finds substance in the submission made by learned State Counsel. Since the election process has been re-notified by Cooperative Election Tribunal vide notification
2025:UHC:1560 dated 01.03.2025, therefore, the grievance raised by the petitioner does not subsist any more.
6. Accordingly, the contempt petition is dismissed. However, petitioner shall be at liberty to challenge the notification dated 01.03.2025 before appropriate forum.
