JUSTICE A.GUNESHWAR SHARMA 17.10.2025 Heard Mr.D.Senapati, learned counsel along with Mr.N.Anix, Mr.Annurann Chetia and Ms.Kavita T, learned counsel for the petitioners and Mr.K.Pradeep, learned counsel for the respondents. By the present petition, petitioners approached this Court with a prayer for setting aside the impugned order dated 13.6.2025 passed by the Recovery Officer-II, Debt Recovery Tribunal, Guwahati. When the matter was first listed on 25.8.2025, this Court issued limited notice as Mr.D.Senapati, learned counsel for the petitioners prays for two months’ time for payment of the balance amount due to the respondents. Mr.K.Pradeep, learned counsel for the respondent/bank have filed reply affidavit raising question of maintainability of the writ petition in the present form and also on merit, stating that enough time had been granted to the petitioner. Mr.D.Senapati, learned counsel for the petitioners submits that the petitioners have not disputed the liability for payment to the respondents and are planning to pay the balance amount as soon some property of the petitioner is sold off and they are not getting proper buyer at the moment and prays for some time. Considering the peculiar facts and circumstance of the case, without going to the merit of the case, the writ petition is disposed of by giving one more months’ time from tomorrow, (18.10.2025) to the petitioners to make payment to the respondent/bank. This Court does not express any opinion on the merit of the case. Misc Case also stand disposed of. Earlier interim order is merged with the final order.
