GP FOR HOME (AP) The Court made the following: 2 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.21164 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue to Writ or Order or Direction more particularly a one in the Nature of Writ of Mandamus declaring the action of the Police particularly Respondents 2 and 3 trying to execute the impugned NBW dated 11-07-2016 in C.C.No.649/2015 on the file of the V Additional Judicial Magistrate of First Class at Kakinada , East Godavari District as against the Petitioner even though the said Impugned NBW is dead/elapsed even then the police are trying to execute the same as against the Petitioner instead of return to the proper court in violation of the Direction issued by the APEX COURT particularly in connection with execution of NBWS reported in AIR 2011 SC 3393 all are illegal and void is against the violation of Articles 14, 19 and 21 of Constitution of India and consequently to direct the Respondent Police to return the dead/elapsed warrant to the proper Court without using the same as against the petitioner and to pass…” 2. Sri R.Siva Sai Swarup, learned counsel for the writ petitioner would submit that the cause in the Writ Petition does not survive for further adjudication, and the Writ Petition has become infructuous. 3.
