Sri.Narayan Mayyar., counsel on behalf of Sri.S.R.Hegde Hudlamane., for the petitioner, Sri.Manjunatha Rayappa., AGA for respondents 1 & 2 and Sri.H.N.Basavaraju., counsel for respondent No.3 have appeared in person.
2. The notice dated:04.10.2017 vide Annexure-H is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition.
3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care.
4. It is stated that an open space was allotted to the petitioner to run the Nandini Milk Booth in General Hospital, Kanakapura. A Notice was issued on 04.01.2017 stating that a tender was required to be called every five years, hence it was

ordered that the petitioner must vacate the open space that was allotted to him for running of Nandini Milk Booth. The petitioner has grievance about the issuance of the notice. In my view, such a notice cannot be called into question in the Writ Petition. If at all the petitioner has any grievance, he can as well suitably reply to the same. I decline to exercise power under the Writ jurisdiction.
5. Resultantly, the Writ Petition is dismissed.
