Neutral Citation No. - 2025:AHC:40266 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 2701 of 2025 Petitioner :- Firoz Karunanidhi Complex L.L.P. And Another Respondent :- Ashok Infra Properties Private Limited Counsel for Petitioner :- Devansh Misra,Kartikeya Saran,Ujjawal Satsangi Counsel for Respondent :- Gaurang Dwivedi Hon'ble Rohit Ranjan Agarwal,J. Supplementary affidavit, filed today, is taken on record. Heard Sri Devanash Mishra, learned counsel for the petitioners and Sri Rahul Agrawal, learned counsel for the respondents. This writ petition has been filed with the following prayers:-
"(i) Issue an appropriate order or direction, calling for record, and setting- aside the impugned order dated 13.02.2025 passed by Additional Civil Judge (Senior Division)/Additional Chief Judicial Magistrate, Court No.1, Jhansi in Original Suit No. 302 of 2024 (Annexure-1 to this petition); (ii) Issue an appropriate order or direction, calling for record, and setting- aside the impugned order dated 20.01.2025 passed by the Court below (Annexure-2 to this petition);"
Learned counsel for the petitioners, at the very outset, submits that he is not pressing the first prayer made in the writ petition which is for setting aside the order dated 13.02.2025. However, as far as the second prayer made in the writ petition is concerned, he submits that the order dated 20.01.2025 be set aside as the application, which was moved by the petitioners, is not contemptuous, and as the matter was pending and the temporary injunction application was not being decided, the transfer application was moved. Sri Rahul Agrawal, learned counsel appearing for the respondents submits that the order dated 20.01.2025 is only a show-cause- notice requiring explanation from the petitioners. I have heard respective counsel for the parties and perused the material on record. From perusal of the order dated 20.01.2025, it is clear that it is only a show-cause-notice given to the petitioners who have to
explain their conduct in regard to their application moved by them. No case for interference is made out. Writ petition is misconceived and the same stands dismissed.
