This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 52/2024 registered at Police Station – Kamleshwarpur, District - Surguja (C.G.) for the offence punishable under Sections 351, 79 of Bharatiya Nyay Sanhita, 2023 and Section 67 of Information of Technology Act. 2. 2 the complainant inter-alia on the allegation that the husband of the complainant is a driver and was residing out of town and the present applicant is residing beside the house of the complainant. The applicant has committed forceful sexual intercourse with her and one FIR has also been lodged against the applicant, the applicant was in jail and after getting bail from the trial Court, the applicant started to make video call to the complainant and being frustrated from the video call she accepted the call of the applicant and applicant stated to force the complainant to get married with the applicant and upon refusal applicant threatened her in name of her father and further applicant pressurized the complainant to reveal her body on a video-call and under the fear of the applicant, she revealed herself in video call and the applicant took screenshot of the same and has sent the same in the mobile number of the complainant husband and tried to outrage her modesty. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case.
It is submitted that the applicant is stated to be neighbour of the complainant and it is stated earlier also she lodged an FIR against the applicant for the offence under Sections 450 and 376 of IPC which was registered as case Crime No. 16/2024 in which the applicant was granted bail by the Trial Court and she raised no objection, a copy of the order is annexed as Annexure A/2 of this bail application and stated that when the applicant returned from jail, she also lodged the present FIR against the present applicant for her oblique motive. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and perused the materials

Considering the facts and circumstances of the case, nature and gravity of allegation made against the applicant and perused the statement of the victim recorded under Section 183 of BNSS, it transpires that the applicant is stated to be neighbour of the complainant and earlier she lodged an FIR against the applicant for the offence under Sections 450 and 376 of IPC which was registered as case Crime No. 16/2024 in which the applicant was granted bail by the Trial Court and she raised no objection, a copy of the order is annexed as Annexure A/2 of this bail application and stated that when the applicant returned from jail, she again lodged the present FIR against the present applicant for her oblique motive, hence, this Court is of the view that the applicant is entitled to be released on bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Ravindra Yadav on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
(b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. 4 (e)The Applicant shall not involve himself in any offence of similar nature in future.
