1. Heard on I.A. No.01/2024, application for condonation of delay in filing the instant CrMP.
2. On due consideration and reasons stated in the application, the same is allowed. Delay of 179 days in filing the petition is condoned.

4. The present petition has been filed under Section 419(3) of the BNSS, 2023 for grant of leave to appeal.
5. This Petition being arguable is admitted for hearing.
6. I have heard learned counsel for the petitioner and perused the
judgment passed by the trial Court as well as related documents.
7. On due consideration, the application is allowed and leave as prayed by learned counsel for the petitioner/State, is granted. Registry is
directed to register the present Cr.M.P. as regular “Acquittal Appeal”.
8. Accordingly, the present CrMP stands disposed of.
9. After registration of regular appeal, let a bailable warrant for a sum of Rs. 5,000/- be issued against the respondent by registered mode through the concerned Superintendent of Police, for his appearance before this Court on 27.02.2025.
