This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India not against any particular order/judgment, but against the inaction done by the respondent authority, whereby the petitioner's father (Lt. Ajmer Singh, retired soldier of Indian Army) entitled for the allotment of land and grant of Patta as per the Madhya Pradesh revenue Mandal 3, 4(3), but till date no action has been taken by the Authority in this regard. The petitioner's father has applied for the allotment of the government land and also started cultivation on Khasra no.310/1, admeasuring area 1.854 hectare & Khasra пo.423, 424 admeasuring area 0.607 hectare (total admeasuring area 2.46 hectare), situated at Village- Sandi, since 1983, but till date the allotment of land & grant of patta has not been done. Hence, this writ petition. 2. At the outset, learned counsel for the parties jointly contended that this writ petition may be disposed of permitting the petitioner to file an appropriate application for grant of Patta regarding land in question as well as an application under Section 52 of the Chhattisgarh Land Revenue Code, 1959 (for short, ‘Code of 1959’) before the respondent/Collector and in-turn concerned Collector be directed to consider and decide the same in accordance with law within an stipulated time frame. 3. In view of above submission, this writ petition is disposed of at this stage permitting the petitioner to file an application for grant of 3 Patta regarding land in question as well as an application under Section 52 of the Code of 1959 before the respondent/Collector within 15 days from the date of receipt of copy of this order and in- turn concerned Collector shall consider and decide the application under Section 52 of the Code of 1959 expeditiously in accordance with relevant law/rules/regulation and in the light of the Circular dated 21.11.1989 (Annexure P-2). 4. It is directed that till decision on the petitioner's application filed under Section 52 of the Code of 1959, no coercive steps shall be taken against the petitioner. CC as per rules.
