JUSTICE JASMEET SINGH O R D E R % 27.01.2025 1. This is a petition seeking interim bail for a period of 2 months in F.I.R No. 209/2022 dated 19.03.2022 pending before the learned ASJ-04, Patiala House Courts, New Delhi, wherein the petitioner has been charged for offences under Sections 302/34 of IPC read with Section 108 of IPC. 2. The present petition is predicated on the fact that the mother of the petitioner is unwell and is in need of urgent medical attention. The petitioner is the only male member who can take care of the mother of the petitioner. 3. In addition, it is also stated that that there are 3 other male members in the family of the petitioner who all are in jail. This is a digitally signed order. In Para 32.3 of the present petition, it is stated that the mother of the petitioner is suffering from severe health issues, including multiple eye diseases, debilitating knee pain. Further, the mother of the petitioner has been advised “TKR” (Total Knee Replacement). 5. On account of non-availability of any male members, the surgery has not been performed so far. 6. Mr. Chauhan, learned APP has handed over a Status Report in Court today which is taken on record. Along with the status report, there are two statements, one of Mr. Ram Ashish Rai and other is of the ex- Sarpanch Harender Kumar Rai. 7. In both the statements, it has been stated that the mother of the petitioner stays with her grandson, namely Akshay Rai. Hence, there is a male member who can take care of the surgery, as and when required. There is also a statement of Chhavinath who is the helper in the house of the mother of the petitioner, who states that the mother of the petitioner is healthy and is only suffering from age related problems. 8. The allegations against the petitioner are of serious in nature. In addition, as per the eye witness, the petitioner has stabbed the deceased victim. 9. For the said reasons, I am not inclined to allow the present. 10. Accordingly, the petition is dismissed.
