JUSTICE AMBUJ NATH ------ For the Petitioner : Mr. Nilesh Kumar, Advocate For the State : Mrs. Priya Shrestha, Spl.P.P. ------ 07/25.04.2025 Heard the parties. 2. The petitioner has been made Lohardaga P.S. Case No. 260 of 2023, corresponding to Drugs and Cosmetic Case No. 01 of 2024, for the offence registered under Sections 276, 406 & 417/34 of IPC, Section 27(d) of the Drugs and Cosmetics Act and Sections 21 and 22 of the N.D.P.S. Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Lohardaga. 3. The bail application of the petitioner was earlier rejected by a Co-ordinate Bench of this Court in B.A. No. 4561 of 2024 vide order dated 19.09.2024. 4. It appears that 119 bottles of Onerex cough syrup were recovered from the possession of the petitioner. It further appears that the quantum of seized cough syrup comes within the purview of commercial quantity. 5. Report regarding the stage of trial and time required for its conclusion, earlier called for from the learned Trial Court, has been received. The learned Trial Court has stated that out of 13 charge- sheeted witnesses, 5 witnesses have been examined. It has further been stated that the trial will be concluded within two months after the examination of prosecution witnesses. 6. Mr. Nilesh Kumar, learned counsel appearing on behalf of the petitioner has submitted that the Hon’ble Supreme Court in the case of Miku Kumar Yadav @ Mikku Kumar Yadav Vrs. The State of Jharkhand in [Special Leave to Appeal (Crl.) No. 148 of 2025] has considered the period of custody of the petitioner undergone by him and has granted bail to the petitioner. Learned counsel has further submitted that the petitioner has remained in custody for more than one and half years. 7. Considering the fact that the learned Trial Court has stated that trial is under progress and it is likely to be concluded soon, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected at this stage once again. 8. The learned Trial Court shall take all necessary steps to conclude the trial as expediently as possible within the period of four months, failing which, the petitioner has liberty to renew his prayer for bail.
