GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION NO. 22277 of 2025 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an order, or a direction, or a writ, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos. 2 to 4 in putting the land of Petitioner in an extent of Ac. 0.52 Cents in Sy.No.329/B of Nandyalampeta Village fields of Mydukur Mandal of YSR Kadapa District in the prohibitory list under section 22-A (1) (a) of the Registration Act, 1908 as per the entries made in the Register of Government lands, Mydukur Mandal in the year 2007 and the action of the respondent Nos. 2 to 4 in not considering the online application of the Petitioner with No. TTA012400117398, dated 23.01.2024 seeking for deletion of land of the Petitioner in an extent of Ac. 0.52 Cents in Sy. No.329/B of Nandyalampeta Village fields of Mydukur Mandal of YSR Kadapa District from the Prohibitory list as illegal, arbitrary and unconstitutional, and to consequently direct the respondent Nos. 2 to 4 to delete the said land of the Petitioner from the Prohibitory list and the Register of Government Lands, Mydukur Mandal, and to mutate the name of the Petitioner in revenue records and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case”. 2. Shorn of all unnecessary facts asserted in the affidavit filed in support of the writ petition, the specific case of the petitioner is that he is absolute owner and possessor of the land in an extent of Ac.0.52 cents in Sy.No.329/B of Nandyalampeta Village fields, Mydukur Mandal, YSR Kadapa District. He has submitted an application No.TTA01400117398, dated 23.01.2024 for deletion of the petitioner’s subject land from the prohibitory property list under Section 22-A(1)(a) of the Registration Act, 1908 and to mutate his name in the revenue records. Despite the petitioner’s persistent requests, the inaction of the 4 respondent authorities in processing the petitioner’s application has constrained him to approach this Court. 3. At this juncture, the learned Assistant Government Pleader for Revenue appearing for respondents would submit that the petitioner has not provided all relevant documents along with the application for consideration and that if the petitioner submits the relevant documents, the same would be considered. 4. Learned counsel for the petitioner states that the petitioner will provide all the relevant documents as required, within one week and the same may be considered by the respondents within a reasonable time. 5. In view of the said representation made by the learned Assistant Government Pleader for Revenue and considering the submission by the learned counsel for the petitioner, without going into the merits of case and with the consent of both the learned counsels, this Court deems it appropriate to dispose of the writ petition, at the admission stage, directing the petitioner to submit all the relevant documents as required for deletion of the subject property from the Prohibitory Properties List under Section 22-A(1)(a) of the Registration Act, 1908 and to mutate his name in the revenue records within one week from the date of receipt of a copy of this order and on receipt of the said documents, the respondents are directed to examine the same and pass appropriate orders on the application, dated 23.01.2024, in 5 accordance with law, within two months therefrom and communicate such decision to the petitioner herein. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
