1. The petitioner has filed this petition seeking following relief:- 10.1 The Hon’ble High Court may kindly be pleased to call for the entire records leading to the impugned in-action for its kind perusal. 10.2 The Hon’ble High Court may kindly be pleased to direct the respondent to consider petitioner for promotion on the post of head master/ Kramonnati after completion of 10 years of service. 10.3 Any other relief, which Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice. 10.4 Cost of the petition be also awarded. 2
2. Fact of the case reflects from the pleadings is that the petitioner is presently working as in-charge headmaster with respondent No.3. She has completed 10 years of service as lecturer in the said school and entitled to be considered for the post of headmaster. 3. Learned counsel for the petitioner submits that the petitioner having minimum eligibility criteria for consideration of her case on the post of Headmaster and respondent No.3 institution being 100% funded by the State Government and rules and regulations framed by the State Government with regard to service condition of the petitioner is also applicable in respondent No.3/ institution. Despite that petitioner has not been promoted on the post of Headmaster with the respondent No.3. though at present she is working as in-charge Headmaster. 4. Return has been filed by respondent indicating that the petitioner is not an employee of Government rather employee of respondent No.3 which is 100% added in educational institution receiving grant in aid from the State Government.
As such it has been mentioned that post of Headmaster for which the petitioner is claiming promotion is not mentioned as a sanctioned post, therefore, promotion cannot be granted. 5. Be that as it may, at this stage this writ petition is disposed of permitting the petitioner to raise his grievances before the respondent No.3 within a period of 45 working days from the date of receipt of copy of this order. If the petitioner is eligible having all the requisite qualifications for promotion on the post of Headmaster and the posts are lying vacant, it will act in accordance with law and proceed further thereof.
