Madan Lal & Ors.3, petitioner seeks decision of his representation dated 23.09.2024 (Annexure P-6) for refund of the amount alleged to have been wrongly recovered from him pursuant to a recovery notice dated 19.01.2012, which was statedly deposited by the petitioner on 12.12.2019. The writ record shows that the present petitioner was one of the petitioners in Inder Singh Bhardwaj & Ors. Vs. The said petition was disposed of with direction to the respondents to consider the cases of the petitioners in light of decisions rendered in Madan Lal2 as also S.S. Chaudhary Vs. State of H.P. & Ors5. The issue of recovery of monetary benefits was also dealt with in Inder Singh Bhardwaj4. Respondents were directed to pass appropriate orders within the time-line indicated therein. In the instant case, neither any order pursuant to Inder Singh Bhardwaj4 has been placed on record, nor there is any challenge thereto. 2. At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh, in accordance with law. 3. Granting such liberty, the present petition is dismissed as withdrawn. Pending miscellaneous applications, if any, shall also stand disposed of.
