JUSTICE ANUP JAIRAM BHAMBHANI O R D E R % 15.01.2025 Pursuant to last order dated 07.01.2025, Mr. Tarang Srivastava, learned APP appearing for the State has handed-up Additional Status Report dated 15.01.2025 addressing the queries put by the court on the last date. The additional status report is taken on record. 2. The additional status report narrates, that in the course of enquiry it has transpired that the petitioner’s earlier house bearing No. H- 16/1046, Sangam Vihar, Delhi (alongwith other houses) was constructed on encroached forest land and was accordingly demolished by the Forest Department; and subsequently the petitioner’s family has relocated to house bearing No. H-16/2213 in This is a digitally signed order. Certain photographs of the demolished house, as well as the house to which the petitioner’s family (comprising his wife and 02 young children) has moved have been appended to the additional status report. 3. The statement of the wife has also been recorded and appended to the additional status report, in which the wife says that the house where they presently reside neither has a permanent roof nor any bathroom facility. A statement of the petitioner’s father to the same effect has also been placed on record. 4. The photographs appended to the additional status report also bear-out the position that the house where the petitioner’s family presently resides is not a pucca house and does not have properly plastered walls or a proper roof. 5. Mr. Avi Kalra, learned counsel appearing for the petitioner submits, that as stated earlier, the petitioner is now seeking interim bail for the limited purpose of relocating his wife and 02 young children to a reasonable pucca accommodation, on rent or otherwise. 6. Mr. Vijay Raj Sehijpal, learned counsel appearing for the complainant reiterates that the petitioner is accused of having committed murder within the jail premises, in a manner which is brutal and shocking. 7. In view of the ground cited by the petitioner for seeking interim bail, Mr. Utkarsh, learned APP appearing for the State leaves it to the court to pass appropriate orders. 8. The Order is downloaded from the DHC Server on 24/01/2025 at 15:07:26 BAIL APPLN. 3728/2024 of his family by being rendered homeless, or by being forced to live in circumstances not conducive to basic human dignity, this court is persuaded to grant to the petitioner – Ved Prakash S/o Satpal – interim bail for the limited purpose of relocating his family to an appropriate accommodation, for a period of 04 weeks subject to the following conditions: 8.1. The petitioner shall furnish a personal bond in the sum of Rs.25,000/- (Rs. Twenty-five Thousand Only) with 01 surety in the like amount from his wife, to the satisfaction of the learned trial court; 8.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address as per prison records/as mentioned in the application; 8.3. The petitioner shall present himself before the Investigating Officer/S.H.O P.S.: Hari Nagar, Delhi every Wednesday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose; 8.4. The petitioner shall furnish to the Investigating Officer/S.H.O P.S.: Hari Nagar, West, Delhi, a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times; 8.5. If the petitioner has a passport, he shall surrender the same to the learned trial court and shall not travel out of the country without prior permission of this court; 8.6. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent. 9.
