The case of the petitioner is that one Sri Chintha Muni Reddy and four (4) others are the absolute owners and possessors of land admeasuring an extent of 435.6 sq. yards in Sy.No.521/1 of Rayalapuram Gram Panchayat Limits, Chandragiri Revenue Village, Chittoor District. 2. It is further case of the petitioner the above individuals expressed their intention to alienate the said land in favour of the petitioner, in pursuance thereof a sale deed was prepared and the same was presented before the 4th respondent for registration. Having received the said sale deed the 4th respondent kept the said document pending registration vide P.No.1463/2021, dated 27.10.2021 on the ground that a Civil Suit vide OS No.512 of 2005 is pending adjudication on the file of V Additional Junior Civil Judge, Tirupati against the subject lands. Accordingly the 4th respondent issued impugned endorsement dated 01.11.2021 refusing to register the sale deed presented by the petitioner. Questioning the said endorsement, the present writ petition is filed. 3. The Counsel for the petitioner would submit that the ground on which the 4th respondent refused to register the sale deed cannot be countenanced for the reason that the said suit was decreed by Judgment and decree dated 11.02.2009. A copy of said judgment and decree is filed along with the present writ petition. He would further submit that in view of the same, there is no impediment for the 4th respondent to register the sale deed presented by the petitioner. 4. It is not in dispute that the suit in OS No.512 of 2005 is decreed on 11.02.2009, the said fact was also not disputed by the Government Pleader for Revenue. In view of the same the impugned endorsement dated 01.11.2021 issued by the 4th respondent is liable to be set aside. Accordingly the present writ petition is allowed by directing the 4th respondent to register and release the sale deed presented by the petitioner under document in P.No.1463 of 2021, dated 27.10.2021, forthwith. 5.
