Heard Mr. Prabhakar Awasthi, learned counsel for the petitioner and Mr. Kripa Shankar Singh, learned Senior Counsel assisted by Mr. Gaurav Singh, learned counsel for respondent no. 6. 2. The instant writ petition has been filed questioning the order dated 25.09.2008 by which the sixth respondent has been selected as principal. 3. Learned Senior Counsel appearing on behalf of sixth respondent has submitted that as the sixth respondent has participated in the selection process, done by the U.P. Selection Education Services Selection Board, and based on the marks obtained in the qualifying subjects, he has been selected and continued in service till attaining the age of superannuation and retired on 31.03.2022. Though the petitioner was assailed the selection, no interim orders were granted by this Court, hence respondent no. 6 joined, continued and retired in the service. In view of the same, the matter becomes infructuous as no cause of action survives to decide the same. 4. Considering the above submissions and also on perusal of the record as the cause of action does not survive in the writ petition accordingly, the same is dismissed as infructuous.
