Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order. Petitioners have been made an accused in connection with Poraiyahat P.S. Case No. 41 of 2024, for the offences registered under Sections 302, 120B, 34 of the I.P.C. and Section 27 of the Arms Act, pending in the Court of learned S.D.J.M., Godda. On 04.04.2024, at about 06:15 P.M., named accused persons and one unknown person had fired upon the father of the informant, due to which, he succumbed to his injuries. Learned Senior Counsel appearing on behalf of the petitioners, has submitted that there is general allegation against four persons that they had fired upon the deceased, but the deceased had sustained only three injuries. It was further submitted that similarly situated co-accused persons have been granted bail by this Court earlier. Learned A.PP. assisted by learned lawyer for the informant has vehemently opposed the prayer for bail. Regard being had to the facts and circumstance of the case and considering the fact that similarly situated co-accused has been granted bail by this court earlier, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Godda in connection with Poraiyahat P.S.
