Heard the parties.
Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer for early hearing of this anticipatory bail application. Since, this anticipatory bail application is taken up today hence, the prayer has become infructuous. Accordingly, this interlocutory application is disposed of being infructuous. (Anil Kumar Choudhary, J.) A.B.A. No. 7890 of 2024
1. Heard the parties. 2. Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Sector-12 P.S. Case No.16 of 2024 registered for the offences punishable under sections 147/148/149/323/324/307/504/506 of the Indian Penal Code. 3. The Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner being
member of an unlawful assembly, in prosecution of the common object of the assembly attempted to murder- Pintu Kumar Saw. It is further submitted that the allegations against the petitioner are all false. Drawing attention of this Court to the supplementary affidavit dated 04.02.2025, it is submitted that at page no.6 thereof, is the joint compromise petition filed inter alia by the petitioner and the informant; which was filed in the court of Judicial Magistrate 1st Class, Bokaro in Sector-12 P.S. Case No.16 of 2024 and therein it has been mentioned that due to some hot talk between the parties and only to save himself, the informant lodged the case against the petitioner and now the parties have compromised the case, outside the court with the intervention of well-wishers. It is then submitted that the informant does not want to proceed with the case any further and there is no dispute between the parties. It is then submitted that the petitioner undertakes to furnish sufficient security including cash security and also undertakes to cooperate with the investigation of the case and further undertakes that he will not annoy or disturb the informant, victims or any of their family members in any manner during the pendency of the case. It is lastly submitted that the co-accused person has already been given the privilege of anticipatory bail by this Court vide order dated 24.03.2025 in A.B.A. No.1892 of 2025. Hence, it is submitted that the petitioner be also given the privilege of anticipatory bail. 4. Learned Addl. P.P. opposes the prayer for grant of anticipatory bail. 5.
Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the abovenamed petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing cash security of Rs. 20,000/- and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bokaro, in connection with Sector-12 P.S. Case No.16 of 2024 with the condition that the petitioner will cooperate with the
investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case; with further condition that he will not annoy or disturb the informant, victims or any of their family members in any manner during the pendency of the case subject to the conditions laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
