No.2107 OF 2025 The Court made the following ORDER :- Questioning the dismissal order, dated 18.07.2025 passed in I.A.No.416 of 2025 in O.S.No.16 of 2020 by the learned Principal Civil Judge (Senior Division), Eluru, the petitioner filed the present Civil Revision Petition under Article 227 of the Constitution of India. 2. The respondent No.1 herein filed the above suit for recovery of an amount of Rs.29,48,400/- on the basis of pronote. The petitioner has taken a plea of forgery. Initially, he filed I.A.No.290 of 2021 in the above suit under Section 45 of Evidence Act seeking to send the pronote along with admitted signatures to the Expert. After hearing both sides, the said I.A. was allowed by order, dated
04.05.2023. Consequently, the disputed pronote along with vakalath, written statement and also bank voucher were sent to the Expert for comparison. The Expert returned those documents with an endorsement ‘opinion could not be drawn on the available signatures’. As such, I.A.No.416 of 2025 is filed seeking a direction to send those documents to another Expert. The said Interlocutory Application was dismissed on the ground that no contemporary signatures were produced by him as the earlier signatures could not be possible for comparison. Consequently, the learned Principal Civil Judge (Senior Division) dismissed the said Interlocutory Application by order, dated 18.07.2025, which is impugned in this Civil Revision Petition. 3. This Court perused the entire material available on record. As seen from the orders, there are no illegality or irregularity in the
3 KSR,J C.R.P. No.2107 OF 2025 impugned order and there is no merits in the Revision Petition and the same is liable to be dismissed. 4. Accordingly, the Civil Revision Petition is dismissed, at the stage of admission.
