GP FOR HOME THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 22686 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ, order, or direction, more particularly a writ of mandamus, declaring the inaction of the 3rd respondent Sub-Inspector of Police, Gandepalli Mandal in not registering the First Information Report (FIR) pursuant to the petitioners complaint dated 08.08.2025, as illegal, arbitrary, unjust, and a gross abuse of power. Consequently, it is prayed that this Honble Court may be pleased to direct the 3rd respondent to take appropriate legal action against the 6th respondent, who is illegally conducting clay excavation operations on the petitioners land, despite the petitioner being a member of a Scheduled Tribe, in violation of the provisions of the SC/ST (Prevention of Atrocities) Act, 1989, as amended. The petitioner prays that this Honble Court may be pleased to pass.…” 2. Heard Sri I. Suryanarayana, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home, on written instructions would submit that on 12.08.2025, respondent No.3 received reports from the petitioner and from another individual that there is a dispute regarding the property. Based on the said reports, respondent No.3 sent a requisition to Tahsildar, Gandepalli with a request to depute surveyor to survey the disputed land in Sy.No.957/1 of K. Gopalapuram Village, Gandepalli Mandal. After receipt of a report from the Tahsildar, respondent No.3 will proceed as per law. 4. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 5. Recording the above said submissions, the Writ Petition is disposed of. However, the police are directed to follow due process of law. There shall be no order as to costs.
