This is an application for addition of the parties, filed by the original complainant on whose complaint/application, an order of cancellation of non-agricultural assessment came to be passed against the petitioner. The applicant states that subject land was allotted to him under a rehabilitation scheme by the Government of Maharashtra. 2. It is also stated in the application that there are many other similarly situated persons to whom lands were allotted and the petitioner by submitting fabricated documents obtained order of non-agricultural komal kamble Page 1 2025:BHC-AUG:20805 937.7895.2023.ca+11401.2022.wp assessment with respect to the land belonging to the applicant and other allottees. 3. Having regard to the contention, the civil application is allowed. The applicant is permitted to intervene in the matter. Writ Petition No. 11401 of 2024 : 4. By the present petition, the petitioner has challenged the order dated 27.10.2022, whereby the order of non-agricultural assessment passed in his favour has been revoked. The contention of the petitioner is that the said order is passed without affording opportunity of hearing to the petitioner. The impugned order also does not indicate that the petitioner was heard. 5. In that view of the matter, the writ petition is allowed. Order dated 27.10.2022 passed by respondent no. 2 - Sub-Divisional Officer, Nagar Division, Ahmednagar is set aside. Respondent No. 2 - Sub- Divisional Officer is directed to decide the application for cancellation of non-agricultural assessment order afresh. 6. Parties shall appear before respondent no. 2 on 18.08.2025. Parties to note that separate notice will not be issued by the authority. Sub-Divisional Officer is directed to decide the application as early as possible and, in any case, on or before 31.10.2025. 7. In case the allottees including the intervenor, namely Mr. B. E. Ghule, intend to appear in the appeal, it will be open for respondent no. 2 / Sub-Divisional Officer to permit them to intervene and advance submissions before deciding the application. [ROHIT W.
