Rakesh Kainthla, Judge The petitioner has +led the present petition for quashing of FIR No. 225 of 2024, dated 8.9.2024, registered for the commission of o4ences punishable under Sections 132, 121(1), 351(3) and 352 of Bhartiya Nyaya Sanhita, 2023 (BNS) based on a compromise between the parties. It has been asserted that the parties have entered into a compromise voluntarily, 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2025:HHC:38114 with the intervention of elders, without any in:uence from any person. The continuation of proceedings would amount to an abuse of the process of the Court. Hence, the petition. 2. The statement of the informant/victim Anil Kumar was recorded on 29.8.2025, in which he stated that he had entered into a compromise with the accused voluntarily without any in:uence from any person and had no objection if the FIR is quashed as per the compromise. 3. Heard. 4. The o4ences punishable under Sections 351(3) and 352 of BNS are compoundable under Section 359 of Bhartiya Nagrik Suraksha Sanhita, 2023 (BNSS). The o4ence punishable under Section 121(1) of BNS corresponds to Section 332 of IPC, and Section 132 of BNS corresponds to Section 353 of IPC. This Court has already quashed the proceedings under Sections 353, 332 and 333 of the IPC in Sumit Kumar Vs. State of H.P. (2020) SCC Online HP 436, Sections 323, 353 and 506 of IPC in Murari Lal Vs. State of H.P. (2023) HHC 628, and Sections 341 and 353 of IPC in Rakesh Kumar and another Vs. State of H.P., Cr.MMO No. 700 of 2019, decided on 1.1.2020. Therefore, in view of these precedents, the present petition is allowed and the FIR No. 225 of 2024, dated 8.9.2024, registered for the commission of o4ences punishable under Sections 132, 121(1), 351(3) and 352 of BNS and consequential proceedings arising out of the FIR are ordered to be quashed. 6. Petition stands disposed of in the above terms, so also pending applications, if any. 7. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certi+ed copy, but if required, may verify passing of the order from the Website of the High Court.
