the offence under Sections 103(1), 109(1) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity BNS). 2. The case of the prosecution is that the defacto complainant is working in Gstar Company as an high stacking supervisor, his work profile is to unload the cargo from vessels and to export them by tippers.
On 07.06.2025 when he went to his work place, he came to know that some cargo got missed from the vessel, which has to be arrived to the Gstar company yard. On 09.06.2026 the defacto complainant and Gompa Sanyasi Rao (deceased) went to work at back side of Adhani Sillo, at about 13.00 hrs some persons belongs to his company came there and questioned them that they stolen cargo on 07.06.2025 and forced them to admit for which they denied. Later on Raya Satyanarayana @ Lagan Beaten Gompa Sanyasi Rao was beaten with the plastic pipes and stickes, as a result he fell into unconscious state at the same time, Koridapalli Ravi, Adhan Khan also assaulted on the defacto complainant with sticks. As a result he sustained grievious injuries and escaped from there. Later he was shifted to KG Hospital for treatment. During treatment, the said Gompa Sanyasi Rao died due to severe beating by the Accused. Hence the above crime was registered. 3. Mrs. Madhavi Latha Katasani, learned counsel for the Petitioner, submits that the Petitioner has not committed any offence, he was falsely implicated in the case; he is the sole bread-winner of his family; he is ready to abide by any conditions imposed by this Court and urged to enlarge the Petitioners on bail. 4. Per contra, Ms. P. Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed to grant bail to the Petitioner, submits that the investigation is still in progress and several material witnesses remained to be examined. It is contended that if the Petitioner is released on bail at this stage, there is strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged to dismiss the Petition. 5. Heard leaned counsel for the Petitioner and learned Assistant Public Prosecutor. Perused the record. 6.
The allegation against the Petitioner/ Accused No. 2 is that he perpetuated the other Accused to commit murder of Raya Satyanarayana. Even though the name of the Petitioner is not shown in the FIR, the other witnesses have spoken clearly about the role played by the Petitioner in their statements recorded under Section 161 of the Cr.P.C and there was CCTV Footage also. Investigation is at nascent stage. Some more witnesses are to be examined. The Petitioner was arrested on 11.06.2025 and he has been in judicial custody for the 79 days. Statements under Section 164 of the Cr.P.C of the victim and the witnesses are yet to be recorded, as per the statement of the learned Assistant Public Prosecutor. 7. For the above reasons, there are no merits for granting bail to the Petitioner at this juncture. Hence, the Criminal Petition is liable to be dismissed for the present. 8.
