The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 19731 has been filed, by the Petitioner/Accused, seeking quashment of the Proceedings against him in Spl.S.C.No.18 of 2024 on the file of the Court of X Additional District Sessions Judge-Cum-SC/ST Court, Krishna at

Machilipatnam, for the offence punishable under Section 323 IPC and Sections 3(1)(r)(s) and 3(2)(va) of SC/ST (PoA) Act, 2015.
Brief facts of the case are that in the month of May, 2023, L.W.2/Peketi Venkata Srinivasa Masthan, who is the close associate of respondent No.2/de facto complainant, has pledged Petitioner’s car bearing No.AP 09 TVA 3770 borrowed an amount of Rs.50,000/- and thereafter, L.W.2 cleared the debt to Petitioner, but the Petitioner refused to return the car. Further, on 12.08.2023 at about 10.00 p.m. respondent No.2 along with his friends and L.W.2/ Peketi Venkata Srinivasa Masthan approached the Petitioner at Revati Center, Machilipatnam to settle the issue. Petitioner allegedly abused and insulted the de facto complainant in the name of the caste in a public place and subsequently, de facto complainant filed a case against the accused. Police after investigation filed charge sheet and the same is numbered as Spl.S.C.No.18 of 2024 on the file of the Court of X Additional District Sessions Judge-Cum-SC/ST Court, Krishna at Machilipatnam. Seeking quashment of the Proceedings against the Petitioner, this Criminal Petition is filed.
Heard Sri K.V.Aditya Chowdary, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing for respondent/State. Perused the material on record.
Learned counsel for the Petitioner would submit that this false case is foisted against the Petitioner without any iota of truth. Further, there is no proof of pledging the car of the respondent No.2 by L.W.2. Learned counsel would

submit that except bald and omnibus allegations, no specific overt acts are attributed against him.
At this juncture, learned counsel for the Petitioner requested to dispense with the presence of the Petitioner before the Trial Court by disposing of this Criminal Petition.
Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
Considering the submissions made, the Criminal Petition is disposed of dispensing with the presence of the Petitioner/Accused before the Trial Court, except on the specific dates as directed by the Trial Court. Petitioner is at liberty raise all his contentions at his defence, and the Trial Court shall consider and take an appropriate decision over the matter according to law. Pending applications, if any, shall stand closed.
