Pursuant to a tender floated by the Radhanagar Gram Panchayat on 25th February, 2019, for construction of ICDS Centre at Bindukata Primary School under the said Panchayat, the petitioner accepted the offer and completed the construction within due time. He raised bill of Rs.7,99,990/- for the said work, out of which Rs.2,07,425/- has been paid. The remaining amount is still not disbursed. Several representations submitted by the petitioner in this regard fell on deaf ears. Further representation submitted by him through his learned advocate on 20th March, 2025 has also not been considered. The petitioner seeks consideration of his representations and payment of the remaining due. In response to an application filed by the petitioner under the Right to Information Act, 2005, the concerned authority has informed that the remaining due has not been paid due to non-availability of fund. Completion 2 certificate has been issued in favour of the petitioner recording that the work has been satisfactorily completed. In view of the fact that the petitioner has completed the work satisfactorily as recorded in his completion certificate, the Executive Officer, Jhargram Panchayat Samity, being the 8th respondent herein, is directed to disburse the due amount of Rs.5,50,758/- in favour of the petitioner within eight weeks from the date of communication of this order. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
