GP FOR HOME The Court made the following Order: This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “… pleased to grant an order or direction more particularly, one in the nature of Mandamus, declaring the action of the Respondents, more particularly Respondent No. 4 and 5, in interfering with peaceful business activities of the Petitioner and thereby brutally harassing them physically without there being any proper cause as being illegal, arbitrary, unlawful, capricious, violative to the cardinal principles of natural justice and Article 19, 21, and 22 of the Indian Constitution and consequently, direct the Respondents not to interfere with the peaceful life of the Petitioner and further restrain them from physically abusing the Petitioner and pass..” 02. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home. 03. Learned counsel for the petitioner would submit that the writ petition may be closed with a direction to the police to follow due procedure established by law, if they intend to interfere with the activities of the petitioner. 04. Considering the facts and circumstances of the case, this Court is of the considered opinion that writ petition can be closed at the stage of admission, without going into the merits of the case by directing the respondent/police to follow due procedure established by law, if they intend to interfere with the business activities of the petitioner. 3 05. Accordingly, this writ petition is closed at the stage of admission. There shall be no order as to costs. As a sequel thereto, interlocutory applications pending if any, shall stands closed.
