ORAL ORDER
Accused in Crime No.249/2025 registered by Hebbagodi Police Station, Bengaluru District, for the offence punishable under Sections 124(1) of BNS, 2023 is before this Court seeking regular bail.
2. Heard the learned counsel appearing for the parties.

FIR in Crime No.249/2025 was registered by Hebbagodi Police Station, Bengaluru District for the aforesaid offence against the petitioner herein, on the basis of first information dated 16.05.2025 received from Sri Shantakumar S/o Muniraja, who is the alleged victim in the present case. During the course of investigation, the petitioner herein was arrested on 16.05.2025 and subsequently remanded to judicial custody.
4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.5218/2025 was dismissed on 09.06.2025. Therefore, he is before this Court.

Learned counsel for the petitioner submits that the victim has suffered simple injury in the incident in question. The maximum punishment for the alleged offence is therefore imprisonment for a period of seven years. The petitioner has no criminal antecedents. Accordingly, he prays to allow the petition.
6. Per contra, learned HCGP has opposed the petition on the ground that investigation is under progress.
7. The first informant Shantakumar is running a fair price shop within the jurisdiction of Hebbagodi Police Station for the last four years. On 16.05.2025 when he was in his shop, at about 2.30 p.m, the petitioner, who was standing in the queue, all of a sudden came near the first informant and asked him to supply rice. When the first informant asked the petitioner to follow the queue, the petitioner who went back, thereafter once again came near the first informant and asked him to supply rice and when the first informant refused he allegedly threw acid on his face and left the spot. The first informant was

immediately shifted to hospital and based on his statement recorded in the hospital, FIR was registered against the petitioner for the aforesaid offences. The petitioner, who was no criminal antecedents is arrested in the present case on 16.05.2025. Major portion of the investigation is completed.

Learned counsel for the petitioner has submitted that the victim has suffered only simple injury in the incident in question and the said submission is not disputed by the learned HCGP. The petitioner had no ill- will or motive as against the first informant. Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively.
9. Accordingly, the following:
ORDER Criminal Petition is allowed.

The petitioner is directed to be enlarged on bail in Crime No.249/2025 registered by Hebbagodi Police Station, Bengaluru District, for the offence punishable under Sections 124(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future;
