Mr. Y.P.S. Dhaulta, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents. 2. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. Petitioner is serving as Junior Basic Trained (JBT) Teacher at Government Primary School, Rambho, Education Block, Mehla-1, District Chamba, H.P. The case set up by the petitioner is that he was previously serving at Government Primary School, Palani, Education Block, 1 Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 Bharmour, District Chmaba, H.P. In view of State policy dated 30.07.2024, Government Primary School, Palani was merged with Government Primary School, Badgran, Education Block, Bharmour, District Chamba, H.P. Consequently, the petitioner was ordered to be transferred to Government Primary School, Rambho, Education Block, Mehla-1, District Chamba, H.P. where he is continuing to serve as on date. It is further case of the petitioner that pursuant to directions issued in School Management Committee versus State of Himachal Pradesh and others,2 respondents-State have again opened Government Primary School, Palani. Petitioner’s grievance is that at the time of his transfer from Government Primary School, Palani, he had not completed requisite tenure at the aforesaid station which is hard area. He, therefore, made representation (Annexure P-4) to respondent No.2 for his shifting/adjustment at Government Primary School, Palani till completion of his normal tenure at the aforesaid station but the said representation has not been considered and decided by the competent authority till date. Learned counsel for the petitioner submits that petitioner would be satisfied in 2 CWP No. 11278 of 2024, decided on 29.11.2024. 3 case the respondents are directed to examine his case in light of the aforesaid judgment within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer. 4.
Looking to the limited grievance of the petitioner, this writ petition is disposed of by directing respondent No.2/competent authority to consider and decide the aforesaid representation of the petitioner (Annexure P-4) in accordance with law and applicable transfer policy, within a period of three weeks from today. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
